November question of the month: Can an employee pay a spouse’s medical bills from an FSA, even if she is not on his medical plan?


Gina, I have an employee who wanted to see if he could pay his wife’s medical bills with his FSA funds. She is not on his plan. Please advise. Thank you! – Julie M., HR Director


Yes Julie.  An employee enrolled in your company’s Health FSA can submit expenses for all legal dependents through the plan regardless of whether they are enrolled in your company’s health plan or not.  As a matter of fact, you may have employees who have waived your group health plan because they have insurance elsewhere.  If they are eligible for your group medical plan, they are eligible for your Health FSA even if not enrolled in the group health plan.
